The recent 2024 Budget Law, published in the Official Gazette on December 30, 2023, has provided clarity regarding the failure to register with the AIRE (Registry of Italians Residing Abroad) in case of moving abroad, imposing significant penalties for those who neglect this obligation. According to the new provisions introduced with a specific article, penalties for omitting the declaration of change of residence range from 200 to 1,000 euros for each year of non-registration. This means that those who fail to register with the AIRE are now exposed to considerable financial risks.

The obligation to register with the AIRE at the time of transfer is stipulated by Article 11 of Law No. 1128 of December 24, 1954. However, the new regulations, effective from January 1, 2024, have substantially increased the penalties, making the enforcement of these rules more stringent.

The provision aims to encourage municipalities to enforce AIRE registration by introducing new measures, such as the obligation of information exchange between state entities and automatic notification to the Revenue Agency by the municipality at the time of AIRE registration. This procedure has been implemented to ensure more effective control over individuals' adherence to the registration obligation.

Before 2024, the application of penalties for failure to register with the AIRE was rare. However, with the implementation of the new regulations, penalties are now applicable to all individuals, including minors in family units. It is crucial to emphasize that the omission of AIRE registration could lead to the formal consideration of still being resident in Italy, with all the resulting consequences. Therefore, it is strongly recommended not to delay registration to avoid such consequences and fulfill regulatory obligations promptly."
